Privacy policy
This Privacy Policy applies to all persons using the online store run by us at https://artndoll.pl, to which we will hereinafter refer to as the "Online Store", and, thus, it applies to you and it is very important that you make yourself familiar with it.
The Policy defines, in particular, the rules for collecting and processing your personal data obtained by us both when registering an account in the Store, using the Store, when shopping without creating an account as well as when subscribing to the newsletter.
If you have any questions, doubts and comments relating to processing of your personal data by us, please do not hesitate to contact us. Your opinion is most important to us.
- 1. PERSONAL DATA CONTROLLER
- The personal data controller is Fundacja Grupa T with its registered office at ul. Toruńska 68, 87-103 Toruń, entered in the National Court Register - Register of Entrepreneurs kept by the District Court in Toruń, 7th Economic Division of the National Court Register under KRS number: 0000426592, NIP 8792668449, REGON number 341319980 (hereinafter referred to as the "Controller ").
- We have not appointed a Data Protection Inspector, however, all matters related to data protection should be reported by e-mail: iza.grupat@wp.pl. The contents of a Report should clearly indicate:
- data of the person or persons to whom the Report relates,
- the event being a reason for the Report,
- present your claims and a legal basis for the claims,
- indicate the expected method of solving of the problem.
- 2. THE PLACE OF STORAGE OF PERSONAL DATA
We store the collected personal data within the European Economic Area.
- 3. THE RANGE AND PURPOSE OF PERSONAL DATA PROCESSING
- Personal data mean information about an identified or identifiable natural person (hereinafter referred to as the "Personal Data").
- The personal data provided by you will be processed for the purpose and to the extent necessary to register in the Online Store, conclude and perform the agreement (purchase of goods), make payments, for the purpose of direct marketing of our goods and services and to examine opinions concerning on the level of satisfaction with the purchase.
- In order to perform the agreement, we will process the following data provided by you: name, surname, address, e-mail address, telephone number, tax identification number, company name, delivery address and the history of orders.
- Additional purposes for which we will process your personal data:
- rendering of services by electronic means and full use of the Online Store, including making transactions and paying for purchases,
- setting up and managing your account or accounts as well as providing support for your account, transactions and solving technical problems,
- handling complaints in the event that you lodge a complaint,
- handling requests sent to us by you (e.g. via the contact form),
- contacting you, including for purposes related to rendering of services,
- processing your data for tax and accounting purposes,
- logistic handling of your order and, in particular, providing your data to courier companies that will deliver your order,
- In order to send to you electronic information and commercial materials in the form of a newsletter, we will process the e-mail address and telephone number provided by you with your consent.
- In order to examine the opinion on the level of satisfaction with the purchase, we will process your telephone number with your consent.
- With your consent, we will also
- monitor your activities and those of all other users, including keyword searches and managing your activities,
- match advertisements with contents you have previously viewed, match categories of offers or particular offers as based on your activity,
- contact you, among others, for purposes related to permitted marketing activities, through available communication channels and, in particular, and with your consent - by e-mail and on the telephone,
- monitor your activities and those of all other users, e.g. searching for keywords, posting offers, carrying out research and analyses, among others, in terms of functionality of the trading platform, improving the operation of services or estimating visitors’ main interests and requirements,
- invite you to loyalty programs, competitions and promotional campaigns, in which you can take part,
- Based on the Controller’s or third party’s legitimate interest, we process your data for the purpose of:
- carrying out statistical analyses,
- storing data for archiving purposes and ensuring accountability (showing that we meet our obligations resulting from provisions of law),
- Your data will be subject to automated processing, including profiling, for the purpose of rendering services related to performance of the agreement and direct marketing. Such processing may result in sending contextual advertising and sharing information on the history of purchases as well as collecting information necessary to make payments.
- If we should plan to process your personal data further for a purpose other than the purpose for which the personal data was collected, we will notify you of that other purpose and provide any other relevant information prior to such further processing.
- Providing your personal data is voluntary, however, refusal to provide data will prevent you from using the Online Store and services rendered by us by electronic means.
- If you provide personal data in order to conclude an agreement with the Online Store, in this case providing your personal data is a condition for concluding this Agreement. Providing personal data in this situation is voluntary, however, a failure to provide the data will be result in inability to conclude the agreement with the Online Store.
- If your personal data are transferred to a Bank in connection with handling and settlement of payments made by you to the Online Store via the Internet using payment instruments, providing the data is required in order to make payments and provide confirmation of its execution by the Bank to the Online Store.
- If your personal data are transferred to a Bank so that the Bank could verify proper performance of agreements concluded with the Online Store and, in particular, ensure protection of payers' interests in connection with their complaints lodged, providing the data is required in order to enable performance of the agreement concluded between the Online Store and the Bank.
- All personal data provided by you are deemed confidential.
- The Controller acts with due diligence in order to protect interests of data subjects, and, in particular, ensures that the data collected by the Controller are:
- processed lawfully and in a reliable and transparent manner for the person, to whom the data relate,
- collected for specific, explicit and legitimate purposes and not processed further in a manner inconsistent with the purposes,
- adequate, relevant and limited to what is necessary for the purposes of processing of the same,
- correct and updated if necessary,
- stored in a form allowing identification of the data subject for a period no longer than necessary for the purposes of processing of the same,
- processed in a manner ensuring adequate security of Personal Data, including, protection against unauthorized or unlawful processing and accidental loss, destruction or damage, using appropriate technical or organizational measures,
- 3. THE BASIS FOR PROCESSING OF PERSONAL DATA
We will process personal data only when we have legal grounds to do so. The grounds that apply to the Online Store, depending on a given case, include:
- The Agreement on rendering of Services or taking actions at a request of the data subject before concluding this agreement (Article 6(1)(b) of the GDPR),
- the legal obligation related to accounting in case of paid services (Article 6(1)(c) of the GDPR),
- the legitimate interest of Fundacja Grupa T, consisting in processing of personal data in order to establish, pursue or defend any claims related to the Online Store, including the Services rendered (Article 6(1)(f) of the GDPR),
- the legitimate interest of Fundacja Grupa T, consisting in profiling users visiting the Online Store for marketing purposes (Article 6(1)(f) of the GDPR),
- the legitimate interest of Fundacja Grupa T, consisting in collecting opinions of Online Store users concerning operation of the Online Store, which allows us to improve the store according to users' suggestions (Article 6(1)(f) of the GDPR),
- the legitimate interest of Fundacja Grupa T, consisting in collecting data for statistical and analytical purposes, which allows us to optimize our Website (Article 6(1)(f) of the GDPR),
- a user's consent expressed in the Online Store in the event that the user consents to processing of his/her personal data (Article 6(1)(a) of the GDPR).
- 4. THE PERIOD OF PROCESSING OF PERSONAL DATA
- Personal Data may be stored for the period of using our Services or when:
- Fundacja Grupa T will cease to have a legal obligation to process Personal Data of the Online Store users,
- in case of marketing activities - until the Customer raises an objection,
- if processing of Personal Data depends on a Customer's consent, the Personal Data may be processed until the consent is withdrawn,
- the possibility of pursuing any claims in connection with our cooperation by each party ceases
- Personal Data will also be stored when other legal provisions oblige the Controller to process the same.
- We will store Personal Data for longer should a Customer have any claims against the Controller, in order to pursue claims by the Controller or pursue or defend against claims of third parties, for the period of limitation of the claims as set out in provisions of law and, in particular, provisions of the Civil Code.
- Depending on the scope of Personal Data and purposes of their processing, the Personal Data may be stored for various periods. In each case, a longer period of storing Personal Data prevails.
- 5. RIGHTS OF USERS OF THE ONLINE STORE
Under provisions of the GDPR, each person, whose personal data we process as the Personal Data Controller, has the right to:
- obtain confirmation from the Controller whether your personal data are processed, and if this is the case, to gain access to the data and obtain the following information:
- concerning the purpose, scope and method of processing your personal data and since when your data have been processed,
- the source from which your data come,
- recipients or categories of recipients, who are given access to the data,
- rectification of your personal data when they prove incorrect,
- completing your personal data, if they are incomplete,
- delete your personal data, if
- the Controller has already accomplished the purpose for which the personal data were collected and the data are no longer necessary for the purposes,
- you withdraw your consent to processing of your personal data for a specific purpose,
- you lodge an objection to processing of personal data for the purposes of direct marketing, including profiling, to the extent that the processing is related to such direct marketing or you object to the processing and there are no overriding legitimate grounds for processing your personal data by us,
- your personal data have been processed unlawfully,
- if your personal data have to be deleted in order to comply with a legal obligation provided for in the European Union law or the law of a Member State, which applies to us.
- limiting of processing of your personal data if:
- you believe that we process your personal data incorrectly - for the period of checking whether you are right:
- it is found that we process your personal data unlawfully and you oppose their removal and only apply for restricting of their processing;
- we no longer need your personal data for the purposes of processing, but you need the same in order to establish, pursue or defend claims;
- you lodge an objection to the processing, in which case we will limit the processing of your personal data until we determine whether there are legitimate grounds overriding your grounds;
- to transfer your personal data, in which case you will receive, in a structured and commonly used machine-readable format, the data that you have provided to us, if the processing is based on your consent or is necessary for performance of an agreement concluded with you as well as necessary to take action before conclusion of such an agreement at your request;
- object to processing of your personal data as based on our legitimate interest, including profiling;
- if we process your personal data for direct marketing purposes, in order to object to the processing of your personal data for direct marketing purposes, including profiling;
- lodge a complaint with a supervisory authority, if you think that the processing of your personal data by us infringes the provisions of the GDPR.
- 6. WITHDRAWAL OF A CONSENT
- You may withdraw your consent to processing of your personal data by us. If you think that you do not to use your account in the Online Store any longer, all you have to do is delete it yourself in the Account/Your profile tab on the Online Store website or inform us by correspondence to the following address: Fundacja Grupa T with its registered office in Toruń (87-103 ) at ul. - If you do not want your personal data to be processed for promotional and marketing purposes or for the purpose of receiving commercial information sent by electronic means of communication or in order to survey opinions concerning the level of satisfaction with the purchase, you may withdraw your consent as described above.
- You can unsubscribe from the newsletter by clicking the link found in the content of the newsletter.
- 7. PROTECTION OF YOUR PERSONAL DATA BY THE CONTROLLER
- We protect your personal data when you purchase in the Online Store in accordance with applicable regulations and applying highest standards of security and data protection.
- We ensure the security of personal data owing to appropriate technical and organizational measures in place aimed at preventing unlawful data processing and accidental loss, destruction and damage of the same. We take all possible measures in order to ensure that your personal data are
- correct and lawfully processed;
- obtained only for specific purposes and not processed further in a manner incompatible with the purposes;
- adequate, relevant and not excessive;
- accurate and up-to-date;
- not stored longer than necessary;
- processed in compliance with rights of the persons concerned, including the right to reserve access to the data;

- not transferred without proper protection;
- Personal data collections are protected against access by third parties. We allow your personal data to be processed only by persons, who are trained in the field of personal data protection and obliged to keep your personal data confidential.
- Personal data are stored only for the period necessary to perform the agreement, the newsletter subscription period or period, for which your account is kept in the Online Store as well as for the period, in which the parties may seek mutual claims under the concluded sale agreement or for the period, in which we are obliged to keep accounting records under provisions of law.
- 8. ENTITIES WITH ACCESS TO PERSONAL DATA
- In connection with services rendered by us, we use third-party services.
- We transfer your data to:
- hosting companies providing us with their servers to run the Online Store;
- Shoper S.A. – the owner of software for building and running online stores, which we use,
- suppliers of tools used for marketing or analytical purposes, unless the user lodges an effective objection to such processing of his/her data by disabling cookies in the web browser,
- e-mail tool providers,
- persons cooperating with us under civil law agreements, provided that the transfer of data is necessary in this respect,
- Internet service providers, e.g. Google,
- suppliers of software for the Online Store service,
- e-payments used for payment for our products,
- suppliers of software for issue of invoices,
- entities providing accounting and bookkeeping services,
- providers of additional services rendered by the Controller, i.e. registers of SSL data encryption services and law firms,
- courier companies or post offices,
- 8. CHANGING YOUR PERSONAL DATA
- If your personal data change, we kindly ask you to update them yourself in your user account, if you have set up one, or to notify us of the fact by correspondence or e-mail to the address: iza.grupat@wp.pl.
- We store your current personal data in order to provide you with best quality services and ensure security of your personal data.
- 9. COOKIES
- We want to inform you that we use "cookies".
- Cookies carry information sent by the server and they are saved on your device (e.g. hard drive of a computer or telephone, tablet). The data obtained using cookies do not allow you to be identified, but they allow us to determine whether our Online Store was visited using a given computer and what you were interested most in visiting our Online Store.
- We use internal cookies in order to:
- adapt the content of the Online Store pages to your preferences and optimize the use of websites, as "cookies" make it possible to recognize a device of the Online Store user and display the website in an appropriate manner as tailored to your individual needs,
- create statistics helping to understand how users of the Online Store use websites, which allows them to be improved (we check how many users we have, for how long users use our website and what content they are particularly interested in)
- maintain session of Online Store user (after logging in), owing to which the user does not have to re-enter the login and password on each subpage of the Online Store,
- provide you with advertising contents that are more tailored to your interests, through the so-called Profiling, i.e. verification of your interests and preferences resulting from the analysis of websites you use,
- In our Online Store, we may use the following types of "cookies":
- necessary "cookies" enabling you to use the Online Store services, e.g. authentication cookies
- "cookies" used for services requiring authentication when using the website, "cookies" used to ensure security, e.g. used to detect abuses in the field of authentication on the website,
- "cookies" enabling collection of information on how websites are used,
- so-called functional "cookies" enabling "remembering" settings selected by the user and personalizing the user interface, e.g. in terms of the selected language or region, from which the user comes, font size, website appearance, etc.,
- so-called advertising "cookies" enabling you to provide you with advertising contents that are more tailored to your interests.
- In many cases, the software used for browsing websites (a web browser) allows the storage of "cookies" on your end device (computer, smartphone, tablet) by default.
- You have the option to disable accepting "cookies" in your software at any time. Detailed information concerning options and ways of handling "cookies" are available in the software (web browser) settings.
- Disabling "cookies" may cause difficulties or even prevent the use of some services on our website, however, it will not prevent you from reading or viewing contents posted on the website, except for those, which are accessed by logging in.
- The online store uses Google Analytics, which uses cookies on your device in order to compile statistics relating to the amount of traffic in the online store and the manner of use of the online store.
- We use Google AdWords in order to advertise our Online Store and its services and Google AdWords use cookies placed on your device.
- We use a server which saves information about the device you use automatically when connecting to the Online Store in the server logs in order to analyse the operation of the IT system, i.e. the type of device and browser you use, date and time of entry, text description of the event and qualification of events.
- Only persons authorized to administer the IT system have access to log files. Log files may be used to compile statistics regarding the assessment of traffic in the Online Store and occurrence of errors that prevent you from being identified.
- The user expresses his/her consent to accept "cookies" by changing the browser settings that enable processing of "cookies" or by expressing consent in the appropriate "window" in the Online Store.
- 10. A CHANGE IN THE PRIVACY POLICY
- In order to provide the highest level of protection of your personal data adapted to the changing reality as well as changing provisions of law, we reserve the right to change this Privacy Policy.
- The changed Privacy Policy will be posted with an appropriate announcement in our Online Store at: https://https://artndoll.modishop.pl/pl/category/24/privacy-policy.
- To any matters not covered by this Privacy Policy, relevant provisions of generally applicable law shall apply. In the event of divergences between the provisions of this Privacy Policy and the above provisions, these provisions shall prevail.
